Update on Richard Paey

We have some good news in the case of Richard Paey.
Richard Paey, a chronic pain patient, is serving a sentence of 25 years for possessing 31⁄2 grams of Oxycodone that he used to block and blunt the effects of his intolerable pain.
A three judge panel of the Florida Court of Appeals issued a split decision in Richard's case last December.
All on the court agreed that the 25 year mandatory sentence that Richard was serving for "trafficking" when he had done nothing of the sort was unjust.
Two of the judges didn't think, however, that the courts had the power to act.
The Court of Appeals told Richard that the injustice of his 25-year sentence didn't fall on "deaf ears," just on the "wrong ears" and they commended Richard to ask the Governor for clemency.
That's what Richard did.
We asked incoming Florida Governor Crist to grant Richard clemency.

The Office of Executive Clemency has now forwarded notice, received just today, that not only has Richard Paey advanced over 400 others waiting to be considered for a waiver of the Rules of Executive Clemency, the Florida Parole Commission decided on June 7th to recommend to the Governor and his cabinet that Richard be granted this waiver.

Under Rule 5 B of the Rules of Executive Clemency, "a person may not be considered for a commutation of sentence unless he has been granted a waiver pursuant to Rule 8 …"
Ordinarily a person must serve one third of a mandatory minimum sentence unless the application "demonstrates extraordinary merit."
The Florida Parole Commission underscores that this is an "advisory" recommendation and the final decision will be made by the Governor and the Cabinet.
But this is wonderful news as it is a significant hurdle for Richard to overcome in order to be considered for executive clemency.
Keep those cards and letters coming in support of Richard's clemency petition - obviously they are being read and carefully considered by the Office of Executive Clemency. Like any important undertaking, this is an ensemble effort.
