Schneider Patients Claim Gov’t Harassment

Comment on: “Schneider Patients Claim Gov’t Harassment”; Alexander DeLuca; Pain Relief Network; 2008-03-23. Mostly regarding news item from KAKE (ABC) TV; 2008-03-21. [Source and Video]




This is deeply disturbing. I urge everyone to view this TV news item from KAKE TV, Kansas.

The article, below, which accompanies the KAKE TV news item (see the video), reports charges of direct intimidation of pain patients by federal law enforcement, and ends with this vaguely reassuring paragraph:

“Meanwhile, former US Attorney Randy Rathbun, who is no longer associated with the office, says, ‘I don’t believe it. I doubt that is happening. That is simply not appropriate.’”

I just wish I could be so optimistically outraged, but given what I know, I am not at all surprised that this sort of “inappropriate” behavior on the part of federal police has been alleged.

Recently a Pain Relief Network member reported to me that she had been contacted by phone by a DEA agent who inquired about why she went out of state to see a physician for pain medication prescriptions. A week later she got a letter from the doc she traveled to terminating her care. I’d bet money this patient’s doc got a friendly call from the DEA to “talk to someone or to ask for something,” for which no warrant is needed according to the US Attorney’s Office (see below).

And this is the same federal government that is trampling all over the First Amendment rights of Siobhan Reynolds, the Pain Relief Network, and citizens of Kansas in pain. [See: Feds Target Pain Patient Group’s President, Roxana Hegeman; Associated Press; 2008-03-07.]

So I guess I’m glad Former US Attorney Rathbun has denounced such aggressive drug war police tactics as applies to law-abiding chronic pain patients, and, presumably, their law-abiding physicians. Unfortunately, I think it is only outrageous or surprising because the media light is shining on Wichita, thanks to Siobhan Reynolds, and so the dirty business as usual is being reported.

This is just the Drug War coming home to roost, hardest upon our weakest fellow citizens. PRN keeps saying it - the cause of untreated and undertreated pain is a civil liberties issue and a civil liberties movement.

Former patients of a federally indicted Haysville doctor say they are being intimidated by the federal government.

Stephen and Linda Schneider, of Haysville, are behind bars facing federal charges of over-prescribing narcotic pain medications. The US Attorney is linking the couple to the overdose deaths of 56 patients.

Now several Schneider patients say federal agents are forcing their way into their homes without warrants, asking a lot of questions, and even taking items that don’t belong to them.

“They grabbed the door and jerked it open,” says one patient who spoke to KAKE News on a condition of anonymity. “And then they grabbed my left arm and pulled it up behind me. They said we can do this the easy way or the hard way.”

This patient says the agents even took a hand written letter that Schneider wrote her from prison.

The US Attorney’s Office says they can’t comment on specific cases, but they say a warrant is required in order to search someone’s home or to force a person to hand over something that belongs to them. However, a warrant is not needed to talk to someone or to ask for something.

Meanwhile, former US Attorney Randy Rathbun, who is no longer associated with the office, says, “I don’t believe it. I doubt that is happening. That is simply not appropriate.”

Alex, former U.S. Attorney Rathbun, did not denounce it. He denied it. He said, "I don't believe it, I doubt thats happening, perhaps it's the law enforcement bias on my part, and this is simply inappropriate." He was referring to the strong arm of the law, and that this behavior, could not and would not happen. Typical.

Defense Attorney Lawrence Williamson denounced it.

This is very disturbing. Does this mean that all Schneider patients are under scrutiny as they try to find treatment, or are they targeting PRN members in retaliation?  Were there any other similar reports of harrassment?

You've heard as much as I have about this, and I'm a Schneider patient myself.

Getting any information about doctors who have lost their practice in the Wichita area is like pulling teeth.  The sad thing is that I'm starting to get used to it.  Anybody else in the Wichita area remember Dr. Piazza?

What in the heck does he mean he doesn't believe that could happen? He works for the corrupted system, he has all the inside info, he know's exactly what the f%$# is going on!!!!!!!!!!

Actually, most of us who saw Dr. Richard Piazza have fond memories of him.  He lost his license to practice in KS when his malpractice insurance refused to renew a few years back.  His office was in downtown Derby, KS.

The only incident leading up to this that I know about was a case where a lady came in to his office in diabetic shock (very high blood glucose levels).  She and her husband were irate that all he did was give her a shot of insulin, and then monitor her glucose levels at regular intervals.  This is EXACTLY what he should have done, but they somehow wanted something more and filed a malpractice claim.

Now, to show just how much of his time they were monopolizing that day, I had a 10 AM appointment that day.  They arrived at about the same time I did, but because of their constantly demanding his time, etc., I didn't get to see him until about 5 PM.

It was normal for Dr. Piazza to be a bit behind schedule, in part because he was one of those osteopaths who always takes the time to educate their patients and answer all of their questions.  The problem here was when a single person tries to monopolize his time for something where A> the doctor was doing exactly what he should have, and B> diabetic shock belongs in immediate care or ER; it shouldn't be taken to the nearest private practice office for emergency treatment unless the patient is unconscious, and really not even then because small offices aren't normally equipped for it..

I've heard that he managed to get a license to practice down in FL, but no details.

::General Disclaimer::  I am NOT a medical professional.  However, I've grown up in a family where everybody either was born diabetic (like my grandmother, type 1), or else is born hypoglycemic and later turns diabetic (like me, officially type 2, in reality, borderline between 1 & 2).

Also, in a family of teachers, people tend to try and learn about their health problems and sometimes wind up knowing more about their condition than some doctors.  (Case & point being the indocrinologist who cut my mother's insulin dose in half and increased her food portions, then had no clue why her glucose levels were rising. - - DUH!)

Yes, although disturbing, doesn't suprise me but still makes me angry as heck that this is happening.  I guess you could say this is the post that put me over the edge.

So everyone, sorry for the little emotional outburst... it's been coming for some time now.  As of today, I'm in meltdown.  cry  Yea, in the big scheme of things, I don't think that my voice matters but collectively our voices do matter.  Just wish that more people were listening.

does anyone know where or how to get your records ?? i was told me mine was sent to a dr. meyers in agusta ,and they said they sent them to that dr. landers ,well neither one has them, and it was well maybe i better not say who was getting them  hope

Yes, we need our dogs. I don't know what I'd do w/out my girls' unconditional love. They love me no matter how cranky I get.. well, except that Diva will show some teeth every now and then if I'm yelling too much.  That's when we have our 'alpha' challenge.  I always win.  I have to; she's a doberman.

HAVE YOU TRIEDTO CONTACT THE CLINIC. YOU REALLY NEED TO HAVE YOUR OWN COPY OF THEM. SOME DR'S WONT TAKE THEM FROM THE PATIENT BUT YOU STILL SHOULD HAVE YOUR OWN COPY. I HAVE A CONTACT THAT IS VERY BUSY AND IT WAS A SMALL MIRICLE THAT SHE WAS ABLE TO FIND THE TIME TO GET THEM FOR ME? DO YOU KNOW HER OR HOW TO GET A HOLD OF HER? MAYBE I CAN CALL HER FOR YOU. EMAIL ME AND LET ME KNOW.

HEY LORI, WE HAD SUCH A HORRIBLE TIME WITH OUR WIRELESS MOUSE, WE JUST KEPT FLYING THROUGH THE BATTERIES. FINALLY WENT BACK TO THE WIRED KIND, SO MUCH LESS HASSLE.

::General Disclaimer::  I am NOT a medical professional.  However, I've grown up in a family where everybody either was born diabetic (like my grandmother, type 1), or else is born hypoglycemic and later turns diabetic (like me, officially type 2, in reality, borderline between 1 & 2).

Also, in a family of teachers, people tend to try and learn about their health problems and sometimes wind up knowing more about their condition than some doctors.  (Case & point being the indocrinologist who cut my mother's insulin dose in half and increased her food portions, then had no clue why her glucose levels were rising. - - DUH!)

My dad was diabetic from childhood and I grew up with his condition. I never once heard of my mom taking him to the dr's office for an emergency like that. If they were going to be such a pain in the neck the doc should have called an ambulance to take them and let them pay for that. He was probably trying to be kind and save them some $. That's one of the biggest problems w/ america. Everyone is sue happy and don't care who they step on in the process. A shot of insulin is the only way to bring the blood suger down. My dad was close to death several times for low blood suger, but never high. It's sad that we lose the good dr's that are so rare to idiots that seem to abound.

ps. My dad was really sick towards the end of his life and was in and out of hostpitals all the time, and it never failed that the nurses would always end up screwing up his blood suger. Finally his diabetic dr told them all to do exactly what my dad told them to do with his insulin and food. I got the biggest kick out of that.

I'm afraid I have no knowledge of where the seized medical records of Dr. Schneiders's patients are. Usually, once a doc is indicted, the records are "lost", for all intents and purposes, to the legal process... which basically means you can't get them, and they don't care.

Don't know what to suggest, Hope, except that you call the Attorney General's office - that would be Tanya Treadway, and SCREAM. BLOODY. MURDER.

Keep calling back and screaming till they get sick of hearing it... then maybe they, your paid government servants, will listen to you.

But I doubt it.

Hope-Were your medical records seized by the government? If that is the case, I don't know what to do either. If they are still at the Schnieder clinic I'm pretty sure I can help you get them. Please contact me.
